What do you need to buy a property in Tenerife?
The Plusvalía property tax is one of two taxes that vendors pay when they sell a property in Spain, the other one being a capital gains tax.
The plusvalía is a municipal tax charged by the town hall on properties when they are sold. It is calculated on the rateable or market value of the property, and the number of years that have passed since the property last changed hands.
The base for this tax is the valor catastral (an administrative value that is usually lower than the market value) of the property. The amount due in tax will depend on how long the seller has owned the property: the longer the period, the higher the amount of tax.
The Capital Gains Tax is a tax applied to the profit gained from the sale of an asset, such as property. In the case of property sales in Spain, this tax is applied to the difference between the purchase price and the sale price of the property, i.e., the profit made.
The rate of this tax varies depending on the amount of the profit and how long the property has been owned. Generally, the higher the profit, the higher the tax percentage. Additionally, there are certain discounts and exemptions available depending on the seller’s situation, such as reinvestment in a new primary residence or the seller’s age.
This tax is paid at the national level through the seller’s income tax return.
If the sales offer would be accepted by the seller, the interested client commits to formalise the purchase of the property in a period of time not longer than three months.
In case that the offer is accepted by the seller, Lemaire Global Properties will prepare the private sales contract between the seller and the buyer where it is set that the buyer client has to pay a 10% deposit of the purchase price to Lemaire Global Properties as intermediary and deposit holder.
All costs and taxes resulting from the transfer of the above men toned property have to be paid by the buyer (Notary- and Registry-costs; land transfer tax) with the exception of the municipal tax (Plusvalía), which has to be paid by the seller.
The rest amount, at the notary, has to be paid by a Spanish bank certified cheque on the name of the seller. Lemaire Global Properties will pay the difference with its commission and the previous 10% deposit to the seller.
